1. Acceptance of Terms

Create Future is owned and built by Somtoo Solutions (www.somtoosolutions.com). By downloading, installing, or using Create Future ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms") between you and Somtoo Solutions ("we", "us", "our"). If you do not agree to these Terms, please do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. We will notify you of material changes via email or in-app notification.

2. Description of Service

Create Future is an AI-powered emotional transformation platform that provides guided meditations, affirmations, emotional coaching, dream visualisation, soundscapes, and personal development tools. Content is generated by artificial intelligence and is intended for personal growth and wellbeing purposes only.

3. Account Registration

To use Create Future, you must create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain the security of your password and accept responsibility for all activity under your account.
Notify us immediately at support@createfuture.app if you suspect any unauthorised use of your account.
Not create an account if you are under 16 years of age (or 13 in applicable jurisdictions).

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe pose a risk to other users or the Service.

4. Acceptable Use

You agree to use Create Future only for lawful purposes and in a way that does not infringe the rights of others. You must not:

Attempt to reverse-engineer, decompile, or extract the source code of the App.
Use automated tools, bots, or scripts to access the Service.
Attempt to gain unauthorised access to any systems, networks, or data connected to the Service.
Upload or transmit any harmful, offensive, or illegal content.
Use the Service to harm, harass, or defraud others.
Resell, sublicense, or commercially exploit any AI-generated content from the Service without our written permission.
Misrepresent AI-generated content as human-authored professional advice.

5. AI-Generated Content Disclaimer

Create Future uses artificial intelligence to generate personalised content including meditations, affirmations, coaching conversations, voice narration, and imagery. By using the Service, you acknowledge and agree that:

AI-generated content may occasionally be inaccurate, incomplete, or inappropriate. Always apply your own judgement.
AI-generated content is for personal growth purposes only and does not constitute professional advice of any kind.
The quality and relevance of AI content depends on the information you provide. You are responsible for the accuracy of your profile and inputs.
We do not guarantee that AI-generated content will meet your specific expectations or needs.
The AI models powering the Service may be updated at any time, which may affect the style or quality of generated content.

6. Mental Wellness Disclaimer

Create Future is a personal development and emotional wellbeing application. It is NOT a medical device, mental health service, or substitute for professional psychological, psychiatric, or medical care.

The App is not designed to diagnose, treat, cure, or prevent any mental health condition, illness, or disorder. If you are experiencing a mental health crisis, thoughts of self-harm, or any other serious psychological distress, please contact a qualified mental health professional or emergency services immediately.

By using the App, you acknowledge that Create Future is not a licensed healthcare provider and that its content does not constitute medical or psychological advice.

7. Intellectual Property

The Create Future name, logo, app design, and all original content created by us are our intellectual property and are protected by applicable copyright, trademark, and other intellectual property laws.

AI-generated content created specifically for your account belongs to you for personal use. You may not resell or commercially redistribute AI-generated content from the Service.

You retain ownership of any content you create and upload to the Service. By uploading content, you grant us a limited licence to store and process it solely to provide the Service.

8. Payments & Subscriptions

Some features of Create Future require a paid subscription. Where paid features exist:

Subscriptions are billed in advance on a monthly or annual basis.
All payments are processed through the Apple App Store, Google Play Store, or our authorised web payment provider. We do not directly handle payment card information.
Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
Refunds are handled in accordance with the applicable store or payment provider refund policies.
We reserve the right to change subscription pricing with 30 days' notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Create Future and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100 (GBP), whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.

10. Termination

You may stop using the Service and delete your account at any time via Profile → Account & Security → Delete Account, or at createfuture.app/delete-account. All your data will be permanently deleted within 30 days.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we determine you have violated these Terms or if required to do so by law.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the EU, you may also have the right to bring proceedings in your local courts under applicable consumer protection laws.
